These Terms of Service (“Terms”) apply to your use of the berkeleyhealth.agency website and to the services Berkeley Health (“Berkeley Health”, “we”, “us”) provides, including our internal advertising-management software, Berkeley Health Ads Manager. By using our website or services, you agree to these Terms.


1. About us

Berkeley Health is a digital marketing agency for healthcare and wellness businesses, based in the United Arab Emirates. You can contact us at max@berkeleyhealth.agency.


2. Client agreements

If you are a client, the written proposal, statement of work or service agreement we sign with you sets out the scope, fees and terms of our engagement. If there is any conflict between that agreement and these Terms, the signed agreement prevails.


3. Our services

We provide digital marketing services, including paid search and social advertising management, search engine optimisation, content, landing pages and reporting. The specific services, deliverables and timelines for each client are agreed in writing.


4. Berkeley Health Ads Manager

Berkeley Health Ads Manager is software we built and operate internally to deliver our advertising services. It is not offered to the public, and only Berkeley Health staff use it.


  • It connects to the Google Ads API through our agency’s Google Ads manager (MCC) account, and can access only the Google Ads accounts our clients have linked to that manager account.

  • It is used to retrieve performance data, produce audits and reports, and prepare recommended changes.

  • Changes to a client’s Google Ads account are applied only after a named person at Berkeley Health approves each change. Changes that affect spending are made within the budgets and limits agreed with the client.

  • The software uses AI-assisted analysis to help prepare reports and recommendations. AI tools never apply changes to an account on their own.

  • How we handle data accessed through the software is described in our Privacy Policy.


5. Client responsibilities

If you are a client, you agree to:


  • Give us accurate information and the access we need to deliver the agreed services

  • Ensure you have the right to grant us access to the accounts, data and materials you share with us

  • Review and approve advertising claims, offers, prices and landing-page content for accuracy and compliance with the laws, regulations and professional rules that apply to your business, including healthcare advertising rules

  • Pay advertising platform costs (such as Google Ads spend) directly or as agreed, separately from our fees, unless agreed otherwise in writing

  • Comply with the terms and policies of the advertising platforms we use on your behalf, including Google’s advertising policies


6. Advertising platforms

Our services rely on third-party platforms such as Google Ads, Google Analytics, Google Search Console and Meta. These platforms are operated under their own terms and policies, and they can change, suspend or reject ads, features or accounts at their discretion. We are not responsible for the actions, availability or policy decisions of third-party platforms.


7. No guaranteed results

Advertising performance depends on many factors outside our control, including competition, platform algorithms, market demand and the client’s own offer, pricing and follow-up. We work to improve results, but we do not guarantee any particular number of leads, sales, rankings, costs or return on investment.


8. Intellectual property

Your materials. You keep ownership of your brand, content, data and accounts. You grant us a licence to use them only to provide our services to you.


Our materials. We keep ownership of our software, including Berkeley Health Ads Manager, and of our tools, templates, processes and know-how. Work we create specifically for you becomes yours once paid for, unless your agreement says otherwise.


This website. The content of berkeleyhealth.agency belongs to Berkeley Health and may not be copied or reused without our permission.


9. Confidentiality

We keep client information and data confidential and use it only to provide our services, except where disclosure is required by law or described in our Privacy Policy.


10. Ending access

Clients may remove our access to their Google Ads account at any time by unlinking it from our manager account. Our software can then no longer access that account. Ending a service engagement is governed by the notice terms in your client agreement.


11. Use of this website

You agree not to misuse our website: no attempting to gain unauthorised access, interfering with its operation, or using it for any unlawful purpose. Website content is provided for general information and is not professional, legal or medical advice.


12. Limitation of liability

To the fullest extent permitted by law, Berkeley Health is not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill, arising from use of our website or services. Our total liability in connection with any service is limited to the fees paid to us for that service in the three months before the claim arose, unless your client agreement says otherwise. Nothing in these Terms limits liability that cannot be limited by law.


13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date.


14. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute arising from them.
